St. Petersburg updates legislation in the field of public-private partnership
At a meeting on January 22, deputies of the Legislative Assembly of St. Petersburg adopted in the first reading the draft law of St. Petersburg submitted by the Governor "On measures to implement the Federal Law on Concession Agreements and Invalidation of certain laws of St. Petersburg."
The document was developed by the St. Petersburg Investment Committee in order to bring regional legislation into line with the federal laws "On Public-Private Partnership, Municipal-Private Partnership in the Russian Federation and Amendments to Certain Legislative Acts of the Russian Federation" and "On Concession Agreements".
Thus, the draft law establishes the delimitation of powers of public authorities in St. Petersburg in accordance with the norms stipulated by the federal law "On Concession Agreements".
Currently, the procedure and conditions for St. Petersburg's participation in public-private partnerships by concluding and executing agreements on behalf of St. Petersburg, including concession agreements, are regulated by the Law of St. Petersburg dated December 20, 2006 No. 627-100 "On St. Petersburg's Participation in Public-Private Partnerships." At the same time, the forms and conditions of St. Petersburg's participation in public-private partnerships provided for by this law, as well as the provisions governing the procedure for conducting a tender for the right to conclude an agreement and the requirements for its participants, currently do not comply with the requirements of federal legislation or have lost their relevance.
Thus, the draft law provides for the invalidation of Law No. 627-100 and the establishment of a division of powers of public authorities in St. Petersburg in accordance with the requirements of federal laws.
Changes in legislation will apply to new concessions and public-private partnership agreements in St. Petersburg. Previously concluded agreements are valid until the end of the term on the terms on which they were concluded, and the rules in force at the time of their conclusion will apply to them.

The portfolio of St. Petersburg at various stages of implementation includes 16 concessions and three public-private partnership agreements for a total investment of more than 850 billion rubles.
The largest are the concession agreement regarding the financing, creation and operation on a paid basis of the Latitudinal High-speed Highway in St. Petersburg; the agreement on the creation, reconstruction and operation on the basis of a public-private partnership of facilities that are part of the property of Pulkovo Airport; the agreement on the creation and operation on the basis of a public-private partnership of an automobile the Western High–Speed Diameter road; a concession agreement on the creation and use (operation) of a tram network along the Kupchino metro station - pos. Shushary – Slavyanka" on the territory of St. Petersburg; a concession agreement on the creation of a multifunctional sports and leisure complex "SKA Arena", concession agreements on the creation and operation of educational facilities - secondary schools and others.
